Article 1 – Definitions
Account: A registration of the Visitor with an email address on the Website that offers the possibility to log into the Website.
Payment Processor: financial institution regulated by De Nederlandsche Bank (DNB / Central Bank of The Netherlands) that processes payments for the Website, Donors and the Donation Page Creator.
Visitor: Anyone who in any way whatsoever, directly or indirectly, uses the Website and/or one of the services offered on and/or by means of the Website.
Donor: Anyone who makes a donation in any way initiated from the Website and by means of the Payment Processor used by the Website.
Costs: Platform costs charged by the Website for use of certain services of the Website, currently 5% of the donation amount, and the transaction costs below charged by the Payment Processor to process the payment, both possibly increased by 21% VAT.

Donation Page: An online donation page for a specific cause created by the Donation Page Creator on the Website.
Dohnate.com: A trade name of LLEMG, registered at the Chamber of Commerce of The Netherlands under number 52604926.
Donation Page Creator: Anyone who creates a Donation Page on the Website.
Terms: The Terms of Service
Website: The online platform accessible under the domain name Dohnate.com.
Dohnate page: A Donation Page.
Article 2 – Applicability
2.1 The Terms apply to any use of the Website, to all services offered by the Website and to all agreements entered into by the Website, directly or indirectly, for the use of the Website and its services , at any given date.
2.2 As a Visitor you agree to the Terms of Service. We advise every Visitor to read the Terms of Service in advance. These Terms of Service may change from time to time, so we advise the Visitor to view this page regularly. The most recent iteration of the Terms of Service always applies to the Visitor, regardless of the date on which the services offered on the Website are taken into use.
Article 3 – Privacy
The Website treats the Visitor's privacy-sensitive data with the utmost care. The Website does not store sensitive data such as your ID, bank account and address. Read our Privacy statement for an explanation of how we handle your personal data and how we protect your privacy as a Visitor of the Website. The Privacy Statement is a part of the Terms of Service.
Article 4 – Account
4.1 A Visitor can create an Account, but must be at least 18 years old to do so. When creating an Account, the Visitor is obliged to fill in the requested registration information truthfully and the Visitor must explicitly agree to the Terms of Service.
4.2 Visitor can only create an Account for themselves. Visitor's account is personal and non-transferable. A Visitor is not allowed to create an Account for another person or entity. The Visitor is not allowed to impersonate another person or entity when creating an Account.
4.3 Visitor is responsible for access to the Account. The Visitor is expected to come up with a secure password for the Account and to keep it safe. Visitor may not share the password for the Account with third parties. If the Visitor suspects that third parties are aware of the password for the Account, the Visitor must immediately change the password. If the Visitor suspects misuse or fraud, the Visitor must immediately report this to the Website at the above-mentioned email address.
Article 5 – Donations
5.1 The Donation Page Creator must be at least 18 years old, in possession of an identity card, bank account and mobile number from one of the countries listed on the registration page. The Donation Page Creator will have to provide this information to the Payment Processor. The Website does not check and/or process this data. The Website does not store this data either. This information is only known to the Payment Processor regulated by De Nederlandsche Bank (DNB / The Central Bank of The Netherlands).
5.2 The donations go directly from the Donor to the Donation Page Creator. The Website does not process donations, the Payment Processor processes the donations. The Website has no financial relationship or agreement with the Donor, Donation Page Creator and Payment Processor for processing the donations made by the Donor to the Donation Page Creator.
5.3 All donations are processed immediately and are irreversible. Each donation is a direct transaction between the Donor and the Donation Page Creator. The Website does not have access to the donations. Only the Donation Page Creator has the possibility to make a refund of a donation to the Donor. The costs incurred by this or a chargeback will be borne by the Donation Page Creator. If the Donation Page Creator or Donor suspects fraud or abuse, they must immediately contact the Website at the above-mentioned email address.
5.4 The Donor may, within the limits of the law, be a minor, provided that there is explicit permission from a parent or guardian.
5.5 The Donation Page Creator is responsible for any declarations, taxes and/or costs related to receiving the donation funds.
5.6 The Donation Page Creator pays the Website for each donation processed by the Payment Processor a platform costs percentage as defined in the article 1 Costs section. The Donation Page Creator pays the Payment Processor for each processed donation the transaction costs as defined in the article 1 Costs section. The platform costs and transaction costs, together the Costs, are paid by the Donation Page Creator and are taken from the processed donation amount.
5.7 The Donor has the option to hide his own name on the Donation Page. The Donor's name is always visible to the Donation Page Creator.
5.8 Since the processed donations are irreversible, it is the responsibility of the Donor to thoroughly check whether the information on the Donation Page provided by the Donation Page Creator is correct before making a donation. Given the nature of the Website, no substantive check can be made from the Website as to the correctness of the information stated on the Donation Page created by The Donation Page Creator. The Website does not guarantee the Donor at any time that the donation made will be used for the purpose as described on the Donation Page by the Donation Page Creator. If the Donor suspects misuse or fraud, this must be reported immediately to the Website at the above-mentioned email address.
5.9 If there are any changes related to the Costs, this will be stated on the Website and in the Terms of Service. If a Donation Page Creator has any active Donation Pages during this change, they will be notified in writing by the Website.
5.10 The Donor is only allowed to make a donation on their own behalf from their own bank account.
5.11 The Donation Page Creator bears full responsibility for the received donations and its proper usage. The Website cannot guarantee that the Donation Page Creator will use the received donations as described on the Donation Page because the received donations and related bookkeeping is not visible and/or traceable for the Website. The Website bears no responsibility to any involved party if the donations are not used by the Donation Page Creator as described on the Donation Page.
5.12 All donations made by the Donor go directly and irreversibly to the Donation Page Creator, regardless of whether a donation goal is stated on the Donation Page and/or whether it has been achieved.
5.13 The donation amounts stated on the Website in the Account of the Donation Page Creator are purely indicative and are an estimation. Since the Website has no financial relationship or agreement with the Donor, Donation Page Creator and Payment Processor for processing the donations made by the Donor to the Donation Page Creator, the Website has no insight into the exact donation amounts. The Website therefore makes an estimate of the donation amounts based on its own calculations and states this in the Account of the Donation Page Creator. Only the Payment Processor knows the exact amounts. No rights can be derived from the amounts stated in the Account of the Donation Page Creator on the Website.
Article 6 – Terms of Use
6.1 The Visitor is not permitted to do the following by means of the Website and/or information obtained via the Website:
(a) Impersonate any person or entity.
(b) Spreading false information, untruths and/or misleading information.
(c) Make health, wellness and/or medical claims.
(d) Incitement to Violence. Be racist, discriminatory or hateful.
(e) Activism with a provocative, polarizing and/or political message.
(f) Seek assistance for legal fees and/or fines.
(g) Distribute personal information of third parties.
(h) Infringe on any intellectual property rights of any third party.
(i) To commit criminal offenses.
(j) Offer and/or solicit sexual acts.
(k) Distribute sexual, pornographic, violent and/or offensive media.
(l) Offer/sell something for donations.
(m) Harassing other Visitors and/or making unsolicited/undesirable requests and statements to them.
(n) Break into (hack) systems used by the Website and/or third parties affiliated to the Website and/or distribute information that encourages and/or makes this possible.
(o) Obtain, possess or distribute any illegally obtained and/or confidential information from the Website.
(p) Publish and/or distribute communication from the Website to the Visitor.
6.2 The Donation Page Creator may only use the donations received for the purpose as described on the corresponding Donation Page on the Website. In the unlikely event that this is not possible, the Donation Page Creator, as the sole administrator of the donations received, is responsible for the communication with and/or any refund to the Donor. In the event of a refund, the Costs incurred will be borne by the Donation Page Creator.
6.3 The Visitor is not permitted to collect information from and/or distributed by third parties on the Website and/or make it available via a database.
6.4 The Visitor will at all times comply with the Dutch laws and regulations regarding their usage of the Website.
6.5 If the Website takes a certain action that has consequences for the Visitor, the Website always strives to inform the Visitor about this. However, the Website reserves the right at all times to:
(a) Terminate, temporarily block and/or adjust an Account without stating reasons.
(b) Deny a Visitor access to the Website without stating reasons.
(c) Terminate, temporarily block and/or modify a Donation Page without stating reasons.
(d) Remove, temporarily block and/or modify all content placed on the Website by third parties without stating reasons.
6.6 A Donation Page is the initiative of the Donation Page Creator. The Website reserves the right to promote the Donation Page, without specific permission from the Donation Page Creator, through various channels on the Website and outside the Website. To make this possible, the Donation Page Creator grants the Website a free, worldwide and non-exclusive license to the content of the Donation Page as long as the Donation Page Creator's Account is active.
6.7 The Website does not at any time offer the Donation Page Creator a guarantee that a donation and/or donation goal will be achieved when creating and publishing a Donation Page on the Website.
Article 7 – Liability
7.1 The Website excludes, within the limits of the law, all liability for damage suffered by a Visitor due to:
(a) using the services of the Website;
(b) misinformation on the Website;
(c) the unavailability of the Website or parts thereof;
(d) the Website or parts thereof being unsafe;
(e) purchase of services offered by third parties on the Website;
(f) fraud or misuse by third parties of the Website or parts thereof;
(g) changes to services on the Website or parts thereof;
7.2 The Website invests heavily in minimizing risks for the Visitor. However, the Website does not guarantee the services of the Website, and services of third parties affiliated to and/or through the Website, and/or the security and/or correct functioning thereof.
7.3 If there is a financial transaction between a Donor and a Donation Page Creator, initiated from the Website, then there is only a financial agreement between the Donor, Donation Page Creator and Payment Processor. The Website is not part of this financial agreement and the Donor, Donation Page Creator and Payment Processor bear all liability for any disputes and/or damages, in whatever form or nature, arising from the corresponding financial agreement and/or transaction.
7.4 The Website may change or terminate the services offered at any time. The Website will endeavor to provide reasonable notice of any such change or termination before it becomes effective, but makes no warranty thereof.
7.5 The Website does its utmost to ensure that the Visitor adheres to the Terms of Service, but given the nature of the Website, it cannot give any guarantee in this regard. The Visitor indemnifies the Website against all liability for damage, in any form, caused by non-compliance with the Terms of Service by another Visitor.
7.6 All content, such as photos, videos, letters and numbers, on and/or from the Website are subject to spelling or typing errors.
7.7 The legal relationship between the Website, Visitor, Donor and Donation Page Creator is governed by Dutch law.
Article 8 – Complaints
8.1 Any complaints can be addressed to the Website at the above mentioned email address. The Website will do its utmost to process the complaint within a reasonable period, taking into account a minimum of 14 days. Try to formulate the complaint as clearly as possible. Never send your Account or any other password to the Website in an email message.
8.2 If you, as a Donor, have a complaint about a donation made to a Donation Page Creator, we advise you to contact the Donation Page Creator directly. This can be done using the envelope icon next to the name of the Donation Page Creator on the Donation Page. If you send the Donation Page Creator a message, your email address will be visible to the Donation Page Creator. The Donation Page Creator can then decide to respond to the received message. If the Donation Page Creator responds, the email address of the Donation Page Creator becomes visible to the person who sent the original message. This way you can both continue the communication via email.
Only send a message with a possible complaint to the Donation Page Creator if you suspect a misunderstanding or dispute that you can resolve together. If you suspect abuse or fraud, please contact the Website immediately at the above-mentioned email address.
8.3 Should complaints, misunderstandings or disputes of a financial nature arise between the Donor, Support Page Starter and Payment Processor, the Website can only assume a mediating role within the desired limits of the parties involved. The Website does not form part of any financial agreement between these three parties.
8.4 If there is a suspicion of abuse or fraud by the Visitor, the Website will seek legal advice and possibly take legal action.
